Bushel Direct LLC is a Washington Corporation. Any disputes arising from the use of its services shall be under the jurisdiction of the courts and laws of the state of Washington and of the United States.
Bushel is a marketplace that allows users to buy and sell commodities on a spot and forward contract basis. As a marketplace Bushel does not buy or sell any commodities listed on the site. Bushel is not a party to any contract for trade made in our system and does not act as an intermediary for funds being exchanged between members conducting trade. All contracts are made directly between buyers and sellers. Bushel makes no warranty expressed or implied as to the accuracy of any posting or the creditworthiness of any buyer.
Bushel reserves the right to terminate, suspend or modify your access to the Website at any time, without notice, for any reason whatsoever. You agree that Bushel shall not be liable to you or any third party for any termination of your access to this Website.
Bushel reserves the right to terminate service without a refund to any member who:
· Makes false or misleading statements or in any way misrepresents a lot for sale
· Fails to enter into a contract after a deal is excepted
· Violates any of the terms set forth by Bushel
· Fails to pay the agreed upon monthly service fees
· Attempts to access any data not intentionally made available by Bushel
· Act in a manner deemed obscene, discriminatory, or unprofessional by Bushel
All transactions negotiated on Bushel must be booked within Bushel. After a buyer and seller establish two way communication on Bushel, any acceptance of a bid or offer should be considered binding pending final credit approval by the seller and contract approval by both parties. Once the parties have entered into negotiation for a lot on Bushel, any attempt to negotiate for the same lot outside of the system is prohibited and could result in loss of membership from Bushel.
You are entirely responsible for maintaining the confidentiality of your password and username. You are responsible for all use of your account. You agree to notify Bushel immediately of any security breach. Bushel shall not be held liable for any loss incurred as a result of anyone else using your account with or without your knowledge.
Any use of robots, spiders, scripts, scrapers, crawlers, etc to access the services or data from Bushel is strictly prohibited.
